Facts

A now-deceased resident had a large outstanding balance due. Cona Elder Law was retained to pursue Medicaid eligibility. While securing all necessary documentation for the Medicaid application and pending Fair Hearing, a Long Term Care Insurance policy was discovered. It became clear from the financial documentation that the former resident was not eligible for institutional Medicaid benefits. Putting the Medicaid application on hold, a claim was filed with the Long Term Care Insurance carrier, including all estate documents, billing records, and medical records.

Cona Elder Law attorneys filed a complete and thorough claim and then stayed in continuous and persistent contact with the Long Term Care insurance representatives to push the claim through to approval. In addition, despite the carrier’s policy of issuing benefit checks only to the estate of a deceased policy holder, our firm succeeded in having payment in the amount of $157,300 issued directly to the skilled nursing facility.
